After the success of the previous version of the FAQs, I thought that it might be useful publishing an updated version of the FAQs to help operators willing to apply for one of the Italian online gaming licenses that will be shortly available:Q. - Why do I need an Italian gaming license to enter into the Italian gaming market? My company already holds a foreign gaming license, what are the benefits of an Italian gaming license?Read this article on the topic "What are the benefits of an Italian Gaming License". Q. - Do I need that my company is established in Italy or that the servers are located in Italy to apply for an Italian gaming license? No, under the draft decree introducing...

The Italian Supreme Court held that the delivery of spams does not breach Section 660 (harassment) of the Italian criminal code that sanctions with the imprisonment up to six months or with a fine up to € 516.46 whoever, in a public place or in a place open to the public, or by means of the telephone, for insistency or other blameworthy reasons, harasses or bothers someone. It is interesting to see that on the same case, The Court of First Instance had taken a different view holding that Section 660 was an "open" provision to be interpreted in accordance with the technical developments of communication technologies. Therefore, even though the harassment was not made by means of the telephone, Section 660 would be...

OUT-LAW.COM reports that a French court ordered French ISPs to block the access for two months to a website offering games to French residents without holding a local gambling license. This decision reminds me that Italian gambling law obliges from 2007 ISPs to implement filters blocking the access to websites run without an Italian remote gaming license that are identified through a black-list updated on a monthly basis by the Italian Gambling Regulator (AAMS). Italian players trying to access to a gambling website run under a foreign license will end up to a page with the AAMS logo and, unless they put in place technical measures able to bypass the filters, they will not be able to access to non-licensed websites.However,...

Most of the companies active in the Italian market are likely to have faced at least once the complex regime governing prize competitions (i.e. marketing initiatives awarding prizes in kind based on the chance or the ability of the participants) and prize operations (i.e. marketing initiatives awarding prizes to all the participants purchasing a product/service). Unfortunately the scenario has now become even more burdensome as promoters planning the launch of prize competition/prize operation shall send the relative documentation to the Ministry of the Economic Development at least 15 days prior to the beginning of the contest. Also, from the 25th of January 2011, it will be possible to perform the delivery of the abovementioned documentation to the Ministry only through...

As expected, the Italian Gaming Authority has notified to the European Commission the draft decree setting out the new Italian licensing regime. The draft decree will be subject to the review of the European Commission up to the 15th of October 2010 and, if no comments are raised by the other EU Member States, it is likely to be finally approved shortly after that. After the publication of the decree on the Official Gazette, new operators will be able to apply for an Italian remote gaming license. On the basis of a preliminary review of the draft decree, the most relevant provisions appear to be the following:the company holding the remote gaming license has to be established in any country of the...

After the long awaited landmark Louis Vuitton v. Google decision, the European Court of Justice (the "ECJ") has issued another interesting decision on the use keywords in search advertising systems (e.g. AdWords) that however reviews the issue on the advertisers' side. The ECJ held that a trademark holder can prohibit from advertising an advertiser that - without the consent of the trademark holder - selected a keyword for an Internet referencing service identical with/similar to trademark registered by the former in relation to goods/services identical to those in respect of which his mark is registered, "where that advertising does not enable average Internet users, or enables them only with difficulty, to ascertain whether the goods or services referred to by the ad originate from the proprietor of the trade mark...

The launch of online slots in Italy led to a 63% growth of the online casino games sector in 2013 according to a report from the University of Milan.Online slots were launched in Italy at the end of 2012 and now represent 50% of € 240 million GGR generated in 2013 from the Italian online casino market.  But the figures of the Italian online casino market are expected to improve in 2014-2015 following the decision from casino game suppliers of preventing their operators from offering games to people located in Italy through non-Italian licensed platforms.  This might create new interest for operators willing to enter into the Italian market. And the market might be attractive also for sportsbetting operators following the...
