AAMS, the Italian gambling authority, has notified to the European Commission the draft decrees regulating betting exchange games and bets on virtual events. The Court of Rome on a case between Google and the Italian TV company, RTI, has issued an interesting decision on liability of Internet Service Providers (ISPs) whose beneficial effects might be considerably affected by the upcoming regulatory developments.RTI had requested the court of Rome to prevent Google from publishing on its blogging platform, Blogger, the images of football matches broadcasted by RTI (through the affiliate company Mediaset) which would have obliged Google to monitor any video published in the future on Blogger in order to prevent a potential breach. The privacy-related issues in securitizations have always been a relevant issue. Indeed, Italian law provided that also the data of companies fell under the scope of data protection regulations with the consequential need to comply with privacy policy notifications towards thousands of creditors whose contract has been assigned as part of the secrutizations for instance. But things have now changed!The Italian Data Protection Authority allowed companies to notify the transfer of agreements to assigned creditors through the publication of the privacy policy on the Italian Official Gazette, but this is not necessary anymore. With more than 2 years of delay the coming into force of regulations allowing betting operators to offer events different from those set forth in the official AAMS schedule (the so called "palinsesto") and on virtual events seems to be closer.Indeed, the peculiarity of Italian sportsbetting regulations is that operators can offer only the events and the types of bets listed in the official AAMS schedule that also validates the relative results. Anti money laundering obligations for online gaming operators are usually underestimated by operators. Entities applying for an Italian remote gaming license sometimes ignore that, despite the establishment of their company abroad, they have to comply with the very stringent Italian anti-money laundering regime.Indeed Law 231/2007 implementing in Italy the EU Directive 2005/60EC provides specific privisions for both online and land-based gaming operators listing the types of data to be collected and the term for which they have to be collected.
