Anti money laundering obligations for online gaming operators are usually underestimated by operators. Entities applying for an Italian remote gaming license sometimes ignore that, despite the establishment of their company abroad, they have to comply with the very stringent Italian anti-money laundering regime.Indeed Law 231/2007 implementing in Italy the EU Directive 2005/60EC provides specific privisions for both online and land-based gaming operators listing the types of data to be collected and the term for which they have to be collected. The European Court of Justice issued a relevant ruling in relation to the courts having jurisdiction on disputes arising from defamation occurred through an Internet website.  The court held that in case of defamation occurred through the Internet the victim can bring the claim:either before the courts of its place of residence and in such case he will be entitled to recover all of the damages caused in all the EU Member States; or before the courts of the place where the contents are made available but in such case the claim shall be limited to the damages caused only in the jurisdiction of that specific court.This approach is the result of the interpretation of Article 5.3 of the EU Regulation...

The Italian Gambling Authority has published the data relating to the Italian remote gaming market as of September 2011 and interesting information can be gained.The most relevant data concern the recently launched games i.e. cash poker and casino games. Indeed, the turnover of cash poker games reached € 888 millions during the month of September, while the turnover of casino games increased to € 275 millions. The last two weeks have been very intense for most of my clients. The issue of the new Italian gaming law licenses which had been suspended because of the claim brought by StanleyBet has now started! Operators that had waited for the entire summer hoping to receive good news can now celebrate.
