Yesterday was a happy day for entities interested in obtaining an Italian online gaming license. Indeed we had reported that the claim brought by Stanleybet for an interim suspension of the proceeding for the issue of new Italian online gaming licenses had led the Italian Gaming Authority (AAMS) to precautionary suspend the issue of the new licenses also for the 17 entities that have already passed step 1 of the application process. In the hearing of yesterday relating to the case, Stanleybet waived its claim for the interim suspension of the licensing process that will be now decided on the merits on the 13th of December 2011. The data relating to the turnover generated by Italian cash poker games during the month of August have been made public and they have been surprising also for the experts of the sector. Indeed, notoriously August is a holiday month for Italians and cities are almost completely empty. However despite of that the turnover of cash poker games was of € 900 millions during the month of August! This is surprising also because cash poker games have been launched in the Italian online gaming market only during the month of July 2011 and a number of new entrants in the market have not been launched yet their platform. Some further good news for poker operators are about to come. The court of Bologne (Italy) issued an interesting decision on the liability of managers of Forums. The decision was issued as part of an interim proceeding started by a company challenging the liability of Yahoo! for defamatory messages published by some users on Yahoo! Answers. In particular, the claimant required the removal of the challenged comments, the disclosure of the data of users that posted such comments and the refund of damages suffered because of the defamatory comments.The court made reference to the liability exemption for hosting providers prescribed by the EU E-Commerce Directive 2000/31 as implemented in Italy and held that Yahoo! is a hosting provider in relation to the users’ comments published on Yahoo! From the 19th to the 22th of September 2011, Milan will become the capital of the gaming world with the EiG iGaming Conference & Expo. The long awaited call for tenders for the award of new Italian licences on videolotteries and AWPs has finally been launched. Entities applying for a licence shall submit their application by the 10th of October 2011.   The requirements and obligations prescribed by the call for tenders are quite stringent. Applying entities shall:be gaming and network operators based in a country of the European Economic Area - this requirement does not prevent the participation to the application procedure of non-gaming companies if they set up a JV with a gaming operator therefore for instance media and telecom companies might tender for the licence;  have accrued (singolarly or through the different companies that are part of the JV) during 2009-2010 a minimum turnover of...

The topic of this summer in the Italian gaming market relates to the Stanleybet claims brought against the decrees regulating the issue of new Italian remote gaming licenses (the so called "Comunitaria decree"). No official statements have been issued but apparently Stanleybet brought two claims against the decree regulating the award of the new licenses and against the Comunitaria decree because they allege (again!) their lack of compliance with the EU principles. The reaction from the Italian Gaming Authority, AAMS, was to precautionary suspend the issue of new licenses up to the hearing on the interim suspension of the decrees that is expected to take place between the end of August and the beginning of September. After a delay of more than 2 years Italian online casino and cash poker games have been finally launched today! These new games are expected to lead to an hystorical change in a country where only 4 casinos are active and criminal laws prohibit the opening of new casinos. The Italian Court of Appeal overturned the recent decision of the Court of Rome reported in a previous post against Yahoo! on the Internet liability regime appliable to search engines relating to the alleged breach by Yahoo! of intellectual property rights through links to websites allowing the streaming view, the downloading or P2P transfer of the movie "About Elly".
