As reported, the deadline for the implementation of the so called EU Cookies Directive regulating cookies in Italy expired. The draft bill for its implementation in Italy – currently subject to consultation – can be misinterpreted as an opt-in or an opt-out for the usage of cookies.
The law proposal makes reference to the need to obtain the prior informed consent for the storage of information on the users’ device, but then adds that such consent can be given also through computer programs.
However, what does an informed consent mean? It is very unlikely that the mere browser settings will be sufficient as in such case there would be no “informed consent” i.e. the consent would be collected without previously informing users on how his data will be processed by the data controller. It is more likely that the idea of the regulator is to require that each website collects the consent to the usage of cookies in Italy only after having provided its privacy policy to the users.
Cookies in Italy are used by almost all websites available on the Internet, therefore the question is: which companies will comply with such obligation? what will be the market standard approach?
