In the past two years, there have been significant advances by the Brazilian government in consolidating a legal and structured market for sports betting and online gambling.

As part of this process, Law No. 14,790/23, regulated the lottery modality of fixed-odds betting, while SPA/MF Ordinance No. 827/24, established the guidelines and requirements for entities seeking government authorization to commercially exploit Betting activities.
Since 2025, only betting companies that have received authorization to operate from the Brazilian government are allowed to act at the national level. This authorization is valid for a period of five years and must be renewed upon expiration.
Aiming to enhance the regulatory framework of the sector, the Secretariat of Prizes and Betting of the Finance Ministry (โSPA/MFโ) recently published the regulatory agenda for the betting market in Brazil for the period of 2025-2026. The agenda outlines thirteen topics that will be regulated during this period, related to (i) the promotion of responsible gambling, prevention of pathological gambling, and mitigation of externalities; (ii) the promotion of a balanced and transparent regulatory environment with appropriate levels of compliance; and (iii) the strengthening of national regulation and supervision. Additionally, the regulations are set to be published quarterly.
Furthermore, the SPA aims to complete the regulation of the final topic by the fourth quarter of 2026. The thirteen topics to be regulated are:
- Development and implementation of a platform for self-excluded bettors and those prohibited from betting (second quarter of 2025);
- Enhancement of the resource allocation model through the use of images, names, nicknames, sports symbols, anthems, and other rights (second quarter of 2025);
- Parameters for the creation of an identification seal for authorized betting operators (second quarter of 2025);
- Modernization of procedures and regulations related to commercial promotion (third quarter of 2025);
- Review of the regulation governing the Exclusive Instant Lottery โ LOTEX (third quarter of 2025);
- Regulation of the economic chain of betting operators, online game providers, and other service providers (third quarter of 2025);
- Establishment of a National Betting System (fourth quarter of 2025);
- Improvement of support for bettors and families dealing with betttig dependency (fourth quarter of 2025);
- Consolidation and enhancement of inspection procedures (First quarter of 2026);
- Review of the authorization procedure for betting operators (first quarter of 2026);
- Review of the requirements and procedures for recognizing the operational capacity of certifying entities (second quarter of 2026);
- Review of the regulation and establishment of procedures for the early gathering of popular savings (third quarter of 2026);
- Review of the sanctioning regime for Betting (fourth quarter of 2026).
With a significant increase in the number of bettors, Brazil has established itself as one of the world’s leading betting hubs. In light of the imminent evolution of regulations involving Betting, it is essential for entities already operating in the authorized betting market, as well as those seeking authorization, to stay informed on the regulatory updates outlined in the 2025-2026 agenda.
